ToI group in squabble over Kannada paper title

PALINI R. SWAMY writes from Bangalore: A first-generation newspaper promoter launches a newspaper with his first name as part of the title. After a few years, he sells the now well-established newspaper to a well-established newspaper group. The new owners (neither of whom share the original promoter’s surname) continue to publish the newspaper in its original name.

Now, if the original promoter buys up the title of another existing newspaper, which coincidentally also has his first name as part of its title, and decides to compete with his first newspaper in the same markets, is he banking on the saleability of his name—or indulging in trademark infringement?

Confused?

Well, that’s the sum and substance of a controversy that has broken out in Bangalore between The Times of India group of Samir Jain and Vineet Jain, and VRL Media owned by the truck operator Vijay Sankeshwar.

Thirteen years ago, Sankeshwar lauched the multi-edition Vijaya Karnataka, which soon became market leader. In 2006, he sold the daily and associated properties to The Times of India group. After the lapse of the five-year no-compete clause, Sankeshwar announced plans to launch a new daily.

He zeroed in on the title Vijaya Vani for his new project.

But The Times group is not amused. In fact, it has apparently issued a legal notice to VRL Media and the matter has landed in the courts in Bangalore. The Times group’s legal notice comes on the eve of Vijaya Vani‘s promise launch on Sunday, April 1.

Vishweshwar Bhat, the former editor of Vijaya Karnataka who now edits Kannada Prabha, points out on his blog:

“If the use of a name like “Vijay” is the cause of the strife, surely Samyukta Karnataka could have objected whenVijaya Karnataka was launched because the word Karnataka was in it? And surely, Praja Vani and Udaya Vani too could take objection to the title Vijaya Vani because the word Vani is in it?”

That’s problem no.1 in The Times argument. Problem no.2 is Vijaya Vani is a title that had been peacefully coming out for a small town called Tumkur, on the outskirts of Bangalore, till Vijaya Sankeshwar purchased it. So, if ToI had no problem with that title for six years, why does it have one now?

Problem no. 3: those who have seen dummy editions of the new (relaunched?) Vijaya Vani  say it will have a picture of the owner, Vijay Sankeshwar, alongside the masthead for a few months. Can either the courts or the registrar of newspapers deny a owner to name a paper after himself with a photo prove?

And who has forgotten the launch of Financial Times by The Times group 20 yers ago that has stymied the launch of the original FT for the last 20 years?

Ordinary mortals buy roses for their beau on Valentine’s Day. Sons of the soil buy TV news channels.

Well, that’s what Bangalore Mirror, the tabloid from The Times of India stable is reporting.

Former Karnataka chief minister H.D. Kumaraswamy, son of the former prime minister and “humble farmer” H.D. Deve Gowda, already runs a general entertainment channel called Kasturi through his legislator-wife Anitha Kumaraswamy.

HDK is now reported to have bought the struggling 24×7 Kannada news channel, Samaya, for Rs 60 crore, as a “gift” for chhoti memsaab, the former movie actress Radhika.

Kumaraswamy told Bangalore Mirror, “Samaya channel is up for sale, and I am in talks with its owner. We still have not completed the deal.”

When we asked the ex-CM whether he was buying the channel for Radhika, he guffawed and hung up.

Kumaraswamy, a former film producer, no longer makes the pretence of keeping his relationship with the actress secret. The two have appeared as a “couple” in religious ceremonies.

Kasturi channel has already begun running “Coming Soon” promos of its news channel—tentatively titled Newz24. The rumour is that a former print journalist reported to be close to Kumaraswamy and currently heading a news channel is likely to take charge of the news channel operations.

Samaya, launched by Karnataka MLA Satish Jharkiholi, has been struggling since launch. Former Suvarna News editor Shashidhar Bhat recently joined the channel but what happens to him under the new owner will be breaking news.

The change of ownership of Samaya is only the latest evidence of a massive shakeup in Kannada media which has seen Vijaya Karnataka editor Vishweshwar Bhat join Kannada Prabha and Suvarna News editor Ravi Hegde join Udaya Vani. Tourism minister N. Janardhana Reddy—one of the infamous Reddy brothers—recently launched a news channel called JanaSri.

‘Vijaya Next’ gives ToI Crest a Kannada avatar

PALINI R. SWAMY writes from Bangalore: The Times of India group has unveiled its latest product in Bangalore: Vijaya Next, a broadsheet, all-colour, Kannada weekly for the “upwardly mobile Kannadiga population“.

The 24-page Friday offering, priced at Rs 6, is a customised version of the Crest edition of The Times of India, complete with shades of its aquamarine colour.

And like Crest, the product offering has the usual “upmarket” mix of relationships, health, education, sex, travel, food, fitness, films, celebrities, automotive, gadgets, and sport.

The strategy behind the hurried launch of Vijaya Next, according to insiders, is essentially the same as ToI’s Crest: to slip it along with the group’s flagship Kannada daily Vijaya Karnataka every week and get more out of the customer’s monthly newspaper bill without increasing the cover price of Vijaya Karnataka.

Vijaya Next is edited by Deepak Thimaya, a well-known TV anchor with almost no newspaper journalism experience on his resume barring a few columns, and is produced by residual staff from the Kannada edition of The Times of India, which was shut down in early March at a day’s notice.

(The Kannada edition of ToI had itself been launched in quest of a similar “upwardly mobile” Kannadiga audience after shutting Usha Kirana, the Kannada newspaper that fell into the group’s lap when it bought Vijaya Karnataka and the now-defunct Vijay Times from BJP parliamentarian Vijay Sankeshwar.)

Vijaya Next has been grandly proclaimed in a full-page ad in today’s Times of India (Bangalore market) as the “first-ever Kannada weekly“, although what that means is unclear when full-fledged features weekly magazines such as Sudha from the Praja Vani group and Taranga from the Udaya Vani group, have been available for decades.

Also, there are innumerable Kannada weekly tabloids, part news, part features and part crime, such as Hi! Bangalore, Lankesh, Agni and so on. Most of them do not carry advertisements as a matter of policy and are priced at between Rs 12 and Rs 15 per copy, giving Vijaya Next a price advantage.

But there is little confusion on what the brand managers mean when they say that Vijaya Next will take an “entertaining look” at the world and stories and issues that matter to you.

“Now read all di stories that matter, nimmade bhasheyalli (now read all the stories that matter in your own language),” reads the copy of a half-Kannada, half-English, half-page ad that runs in Vijaya Karnataka, which has lost considerable ground to the Deccan Herald-owned Praja Vani in the last two rounds of the ABC.

If nothing else, Vijaya Next will muddy the waters before Rajeev Chandasekhar‘s Jupiter group begins ploughing in money into Kannada Prabha, in which he bought a stake recently. It will also perhaps prevent him from finding people to staff the paper. Many of the ToI Kannada staff were absorbed in Vijaya Karnataka as a preemptive measure.
